Galuppi’s agrees to pay the Band a total of $_________ for the performance.

Please initial each item below.

  1. The Restaurant agrees to promote the performance through its regular promotional channels.
  2. Galuppi’s requires bands to post on all their social media platforms, share Galuppi’s promotional content.
  3. Galuppi’s requires bands to share any promotional material with Galuppi’s marketing team. Material includes but is not limited to; vertical, clear band pictures and band logos.
  1. Stages sound and lights will be provided by Galuppi’s.
  2. Load-in time is at 2pm. Sound Check will follow after load-in and set up are complete. The Band will provide their own musical instruments and equipment, and ensure they are all in working order. Including but not limited to batteries, stands, microphones, cords, fans. Galuppi’s will not provide any replacement equipment.
  1. Rain or Shine Policy: Galuppi’s shows proceed regardless of weather. Our locations ensure band members and equipment stay dry. Postponement Rights: Galuppi’s may postpone shows due to severe weather.
  2. Cancellation Policy:
    1. No Fee: if Galuppi’s cancels before the band’s arrival or equipment setup, there is no fee, to be paid. Galuppi’s reserves the right to reschedule the show.
    2. Half Fee: If the show is canceled when the band is halfway through setup, half of the contracted amount will be paid.
    3. Full Fee: If the band plays at least one song, the full contracted amount will be paid.
  1. The Band agrees to perform for the entire duration of the agreed time and provide a professional and entertaining performance.
  2. The Band agrees to be well-rehearsed, behave professionally and maintain clean and professional attire throughout the performance.
The Band agrees to comply with any sound and volume restrictions imposed by Galuppi’s Sound Technician Vincent Cusamano.
  1. The Band shall maintain their own liability and workman’s compensation insurance, and provide Certificate of Insurance listing Galuppi’s and the city of Pompano Beach as additional insured.
  2. The Restaurant shall not be liable for any damage to the Band’s equipment or personal injury to the Band members.
  1. Each party agrees to indemnify and hold harmless the other party from any claims, damages, or liabilities arising out of the performance, except in cases of the other party’s negligence or willful misconduct.
  2. Actions and conduct of the band and/or band members resulting in bodily injuries or property damage are the sole responsibility of the Artist/Band
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles, and in the event of any litigation arising out of this agreement, venue shall be Broward County, Florida, It’s prevailing party shall be entitled to recover reasonable attorneys fees and court costs.
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements, either written or oral.
Any amendments to this Agreement must be made in writing and signed by both parties.
